A BILL FOR AN ACT

 

 

relating to education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Sex trafficking prevention education.  (a)  The department shall offer voluntary training for teachers and educational officers on sex trafficking prevention, including:

     (1)  Strategies for preventing the sex trafficking of children; and

     (2)  Identifying victims of sex trafficking.

     (b)  Beginning with the 2016-2017 school year, each middle, intermediate, and high school operated by the department shall provide to students sex trafficking prevention education, the content of which shall include but not be limited to:

     (1)  Methods used to lure children into sex trafficking;

     (2)  Identifying victims of sex trafficking;

     (3)  Effects of sex trafficking on a victim's social, mental, and physical health;

     (4)  Strategies to assist in the prevention of the sex trafficking of children; and

     (5)  Resource information for victims of sex trafficking.

     (c)  Sex trafficking prevention education shall be:

     (1)  Age appropriate;

     (2)  Aligned with the department's standards, state content and performance standards, and general learner outcomes for grades six through twelve;

     (3)  Evidence-based and medically accurate;

     (4)  Culturally sensitive;

     (5)  Adaptable for special education students and students with limited proficiency in the English language; and

     (6)  Coordinated with other agencies to provide services to students who have been identified as victims of sex trafficking or at risk of victimization for sex trafficking.

     (d)  At their own discretion, teachers may answer in good faith any question initiated by a student that is reasonably related to and consistent with the content of sex trafficking prevention education.

     (e)  Parents or legal guardians of students in middle, intermediate, or high school may choose not to allow their children to participate in sex trafficking prevention education.

     (f)  Sex trafficking prevention education shall not discriminate on the basis of sex, race, ethnicity, national origin, religion, disability, sexual orientation, or gender identity.

     (g)  The department may contract with any state or county department or agency, any victim services provider, or any other expert in the field of sex trafficking prevention to implement this section.

     (h)  As used in this section:

     "Age appropriate" means suitable to a particular age or age group based on developing cognitive, emotional, and behavioral capacity typical for that age or age group.

     "Medically accurate" means verified or supported by research conducted in compliance with accepted scientific methods and recognized as accurate and objective by professional organizations and agencies with expertise in the relevant field, such as the federal Centers for Disease Control and Prevention, the American Public Health Association, the American Academy of Pediatrics, and the American College of Obstetricians and Gynecologists.

     "Sex trafficking prevention education" means prevention education in any medium regarding any of the acts described in part I of chapter 712.

     "Victim services provider" means any non-governmental organization that provides social, medical, mental-health, legal, case-management, or housing services to victims of sex trafficking."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
