A BILL FOR AN ACT

 

 

relating to greenhouse gas emissions reduction.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the use of fossil fuels in the State is the primary contributor to greenhouse gas emissions in the atmosphere.  These emissions contribute to climate change, which poses a serious threat to Hawaii's economic well-being, public health, infrastructure, and environment.  Hawaii's dependence on fossil fuels also drains the economy of billions of dollars each year, makes residents vulnerable to the volatility of oil prices, and puts residents at increased risk of being negatively impacted by natural disasters.  Thus, Act 15, Session Laws of Hawaii 2018, established a goal for Hawaii's economy to become carbon neutral by the year 2045.

     The legislature further finds that the transportation sector accounts for the use of more than two-thirds of the oil imported into the State.  The legislature notes that electric vehicles provide a viable, cost-effective alternative to vehicles having internal combustion engines.  However, in order for the adoption of electric vehicles to continue to grow, Hawaii must ensure that adequate infrastructure is in place to support the adoption of these vehicles.  The legislature also finds that by helping to enhance grid flexibility, electric vehicles and electric vehicle infrastructure can play a critical role in helping the State to reach its goal of achieving one hundred per cent renewable power generation.

     The legislature recognizes that there are many questions to consider in the development of statewide electric vehicle infrastructure to ensure that the infrastructure serves areas and populations that are currently underserved and that the technology is functional, reliable, accessible, and operated in a way that contributes to the functionality of the grid and its ability to accommodate more renewable energy and distributed generation.

     Accordingly, the purpose of this Act is to require the Hawaii state energy office to provide recommendations for a comprehensive approach to the development of electric vehicle infrastructure.

     SECTION 2.  (a)  The Hawaii state energy office shall conduct a study to make recommendations for a comprehensive approach to the development of electric vehicle infrastructure in the State to support the State's transition to clean transportation.

     (b)  The study shall include but not be limited to consideration of the following:

     (1)  Repair and maintenance of electric vehicle charging stations and methods to ensure that publicly accessible charging stations are reliable;

     (2)  Potential forms of ownership of electric vehicle infrastructure, including but not limited to ownership by one or more electric utilities or an authorized and regulated monopoly;

     (3)  If the electric vehicle infrastructure is not owned by an electric utility:

          (A)  The roles that various electric utilities could have in electric vehicle infrastructure;

          (B)  The best approach for electric utilities to interact with electric vehicle infrastructure; and

          (C)  Incentives that the electric utilities could offer to develop electric vehicle infrastructure;

     (4)  Possible methods of:

          (A)  Collecting, sharing, and using data;

          (B)  Networking electric vehicle charging stations;

          (C)  Optimizing the use, siting, and sharing of electric vehicle charging stations, including but not limited to the possible utilization of technology;

          (D)  Accelerating any permitting processes necessary for electric vehicle charging stations; and

          (E)  Financing the construction of proposed electric vehicle infrastructure, including on-bill financing and the use of rebates;

     (5)  Incentives that the electric utilities could offer to accelerate adoption of electric vehicles in the State;

     (6)  Best methods for managing and sharing charging stations for multi-unit dwellings; and

     (7)  Identifying entities that have avoided greenhouse gas emissions and devising a framework for awarding to those entities an instrument similar to carbon credits.

     (c)  The Hawaii state energy office shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than sixty days prior to the convening of the regular session of 2022.

     SECTION 3.  The Hawaii state energy office may contract the services of a consultant with the funds appropriated in section 4 of this Act; provided that the contracting of services under this Act shall be exempt from chapter 103D, Hawaii Revised Statutes.

     SECTION 4.  There is appropriated out of the energy security special fund the sum of $           or so much thereof as may be necessary for fiscal year 2020-2021 for the Hawaii state energy office to conduct a study to determine the most effective approaches to regulate, manage, and prepare for an electric vehicle infrastructure in the State.

     The sum appropriated shall be expended by the Hawaii state energy office for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2020.
