A BILL FOR AN ACT

RELATING TO OPIOIDS.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 329E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§329E- Opioids; standardized metrics; value-based purchasing. (a) By July 1, 2024, the department of health shall develop and implement standardized quality metrics to track and address health care processes and outcomes applicable to:

(1) The improvement of the quality of care; and

(2) Targeting, through value-based purchasing, improvement in outcomes,

for patients having opioid use disorders.

(b) The quality metrics shall adhere to all applicable regulations and standards established by the federal Substance Abuse and Mental Health Services Administration.

(c) By January 1, 2025, the department of health shall implement value-based purchasing based on the standardized quality metrics developed pursuant to subsection (a). The value-based purchasing shall be applicable to all state purchases of health and human services entered into after January 1, 2025.

(d) The department of health shall require health service providers to collect and report to the department the following information:

(1) Levels of prescribed opioids, including opioids dispensed for in-patient and emergency department use;

(2) Inpatient and emergency department use for opioid use disorders;

(3) Duration of medications for opioid use disorder pharmacotherapy;

(4) Retention in treatment; and

(5) Counseling rates.

(e) The department of health shall submit an annual report to the legislature no later than twenty days prior to the convening of each regular session that includes:

(1) A compilation of the data compiled pursuant to subsection (d); and

(2) An update on the implementation of value-based purchasing.

(f) As used in this section, "value-based purchasing" means a system that correlates payments to providers with measures of quality of care and outcomes delivered."

SECTION 2. (a) There is established a working group within the department of health for administrative purposes. The working group shall determine major shifts in operations and clinical models that substance use disorder treatment providers need to make before adjusting to efforts to incentivize new demands for higher quality care. In conducting its work, the working group shall consider:

(1) What infrastructure needs to be developed;

(2) What operations need to be redefined;

(3) How to address provider workforce needs;

(4) How to build new clinical practices; and

(5) How to provide substance use disorder treatment providers with more support and information.

(b) The working group shall consist of the following members:

(1) The director of health, or the director's designee, who shall serve as chairperson of the working group;

(2) A member of the senate, to be selected by the senate president; and

(3) A member of the house of representatives, to be selected by the speaker of the house of representatives.

(1) Hawaii Substance Abuse Coalition;

(2) Hawaii Medical Service Association; and

(3) Any other agency or designee deemed appropriate by the chairperson of the working group.

(d) The working group shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2023.

(e) The working group shall cease to exist on June 30, 2023.

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect on July 1, 2112.

Description:

Requires DOH to implement standardized quality metrics to track and address health care processes or outcomes applicable to improving the quality of care for patients having opioid use disorders and targeting through value-based purchasing improvements in outcomes for patients having opioid use disorders by 7/1/2024. Requires DOH to implement value-based purchasing based on the standardized quality metrics by 1/1/2025. Directs DOH to collect certain data regarding opioid use. Requires annual reports to the legislature. Establishes a working group to determine major shifts in operations and clinical models that substance use disorder treatment providers need to make before adjusting to efforts to incentivize new demands for higher quality care. Effective 7/1/2112. (HD2)
