A BILL FOR AN ACT

 

 

RELATING TO APPRENTICESHIPS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that a sector of public high school students, for a variety of reasons, be it financial or scholastic, may choose not to pursue a college education.  The legislature further finds that providing these students with opportunities to develop technical skills and traits outside of college will enable these students to enhance a career after graduating from high school.

     The legislature also finds that the department of labor and industrial relations is well suited and positioned to develop and implement a high school apprenticeship program, as based on its existing apprenticeship program, it already has the appropriate experience and infrastructure.

     The legislature further finds that the department of education and department of commerce and consumer affairs should provide assistance and cooperation to the department of labor and industrial relations to successfully develop and implement the high school apprenticeship program.

     The purpose of this Act is to require:

     (1)  The department of labor and industrial relations to develop and implement a high school apprenticeship program in public and charter schools with grades nine through twelve in the State; and

     (2)  The department of education and department of commerce and consumer affairs to assist and cooperate with the department of labor and industrial relations in the development and implementation of the program.

     SECTION 2.  Chapter 372, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part    .  High school apprenticeship program

     §372-     Definitions.  As used in this part, the following terms shall have the following meanings unless the context clearly indicates otherwise:

     "Program" means the high school apprenticeship program required by this part.

     "Student apprentice" means a student participating in the program.

     §372-     High school apprenticeship program.  (a)  The director shall develop and implement a high school apprenticeship program in schools established and maintained by the department of education pursuant to chapter 302A and charter schools authorized pursuant to chapter 302D with grades nine through twelve.  The program shall provide instructions and training to student apprentices to meet occupational licensing requirements established by the department of commerce and consumer affairs.

     (b)  The superintendent of education and director of commerce and consumer affairs shall, upon the request of the director, provide at their own cost and expense, any assistance and cooperation requested by the director for purposes of this part.

     (c)  The director, with the assistance of the superintendent of education and director of commerce and consumer affairs, shall submit an annual report to the legislature no later than twenty days prior to the convening of each regular session, commencing with the regular session of 2021.  The report shall include:

     (1)  The status of the development and implementation of the program, including a time table and summary of the scope of the program;

     (2)  The respective roles, participation, and contributions of the department, department of education, and department of commerce and consumer affairs to develop, implement, and sustain the program;

     (3)  Any financial and legal impediments to fully develop, implement, and sustain the program; and

     (4)  Any proposed legislation deemed necessary to fully develop, implement, and sustain the program.

     §372-     Rules.  The department may adopt rules pursuant to chapter 91 to implement this part."

     SECTION 3.  Chapter 372, Hawaii Revised Statutes, is amended by designating sections 372-1 through 372-8 as part I and inserting a title before section 372-1 to read as follows:

"PART I.  GENERAL PROVISIONS"

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much there of as may be necessary for fiscal year 2020-2021 for the development and implementation of the high school apprenticeship program required by this Act.

     The sum appropriated shall be expended by the department of labor and industrial relations for the purposes of this Act.

     SECTION 5.  This Act shall take effect on July 1, 2020.
