A BILL FOR AN ACT

 

 

relating to noise.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 342F, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§342F-    Leaf blowers; rules.  (a)  The department shall determine the maximum reasonable noise level of a leaf blower and adopt rules in accordance with chapter 91 for the purpose of this section.  No person shall operate a leaf blower with a noise level greater than that established in the department of health rules.

     (b)  For the purposes of this section, a "leaf blower" means a machine, consisting of a tube through which air is blown by a gas or electric motor, used to move leaves or debris."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
