A BILL FOR AN ACT

 

 

RELATING TO THE DEPARTMENT OF EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-    Fundraising and charitable activities; school projects.  (a)  Notwithstanding any law to the contrary, nothing shall prohibit a school or class from participating in fundraising or charitable activities in conjunction with an organization that is exempt from federal taxes under section 501(c)(3) of the Internal Revenue Code of 1986, as amended, and registered under section 467B-2.1 or granted an exemption from registration under section 467B-11.5, as part of a school project when the fundraising or charitable activities benefit student learning pursuant to criteria established by the department.

     (b)  In the implementation of subsection (a), the department shall take all steps necessary to prevent:

     (1)  The preferential treatment or selection of specific charitable organizations; and

     (2)  Coercive or otherwise undue behavior on the part of department employees that may pressure students or their families into participating against their will.

     (c)  The department shall establish rules, including student learning and ethical criteria, under chapter 91 for the purposes of this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2015.

Description:

Bars prohibition of student or class participation in a fundraiser or charitable activity in conjunction with a nonprofit organization as part of a school project when participation benefits student learning.  Requires the department to take all steps necessary to prevent the preferential treatment of specific charities and undue pressure on school children or their families to participate in charitable activities.  (HB12 HD1)
