A BILL FOR AN ACT

 

 

relating to offenses against public order.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§711-    Human consumption of or trafficking in dog, cat, or equine animal meat.  (1)  A person commits the offense of human consumption of or trafficking in dog, cat, or equine animal meat if the person intentionally:

(a)  Causes, by the person's self or in conspiracy with another, the death of a dog, cat, or equine animal for the purpose of human consumption;

(b)  Sells, exchanges, trades, or barters dog, cat, or equine animal meat for the purposes of human consumption;

     (c)  Consumes dog, cat, or equine animal meat;

(d)  Possesses dog, cat, or equine animal meat; provided that this paragraph shall not apply to a pet owner, pet cemetery, or pet crematory that possesses a dead dog, cat, or equine animal for the purposes of burial or cremation; or

(e)  Transfers to or receives from another person dog, cat, or equine animal meat.

(2)  This section shall not apply to:

(a)  registered animal shelters, veterinary clinics, pet cemeteries, or pet crematoriums that possess a dead dog, cat, or equine animal for the purposes of burial or cremation;

(b)  legally and properly conducted activities carried on for scientific research governed by standards or accepted scientific or educational practices; or

(c)  pet owners in the process of legally and properly disposing of a deceased pet animal.

     (3)  As used in this section:

     "Dog, cat, or equine animal meat" means the carcass or part of a carcass of a dog, cat, or equine animal.

     "Sells" means to transfer to another for consideration.

     (3)  Violation of this section shall be a misdemeanor."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
