A BILL FOR AN ACT

 

 

relating to education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to allow any home-schooled student to participate in extracurricular and co-curricular activities at the public school that the home-schooled student would be assigned to if the home-schooled student attended a public school.

     SECTION 2.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A-     Home-schooled students; extracurricular and co-curricular activities.  (a)  Notwithstanding any law to the contrary, beginning with the 2014-2015 school year, each public school shall allow any home-schooled student to participate in any extracurricular and co-curricular activity offered by the public school, including but not limited to interscholastic competitive sports, academic teams, and clubs.

     (b)  The home-schooled student shall be eligible to participate in extracurricular and co-curricular activities at the public school to which the home school student would be assigned pursuant to the department's school attendance policies.  Geographic exceptions shall not be granted to any home-schooled student for the purposes of this section.

     (c)  To participate in an extracurricular activity or co-curricular activity, a home-schooled student shall meet all the requirements imposed by the rules adopted by the department to effectuate the purpose of this section.

     (d)  A public school may charge a home-schooled student a participation fee as a prerequisite to participation in an activity, if enrolled students are also charged a participation fee for the same activity.  The fee shall be equivalent to the amount that the school would charge an enrolled student to participate in the activity; provided that any fee collected pursuant to this subsection shall be used to fund the particular activity for which it is charged and shall not be expended for any other purpose.

     (e)  The department shall not be responsible for the transportation of a home-schooled student when the student is in transit from the student's home to the site of the extracurricular or co-curricular activity.

     (f)  The State shall not be liable for any incident occurring or injuries sustained by a home-schooled student when the student is in transit from the student's home to the site of the extracurricular or co-curricular activity.

     (g)  The department shall adopt rules pursuant to chapter 91 to effectuate the purposes of this section."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
