BILL TO BE ENTITLED
AN ACT
To
amend an Act creating the Recorder's Court of Gwinnett County, approved March
27, 1972 (Ga. L. 1972, p. 3125), as amended, particularly by an Act approved
March 5, 1987 (Ga. L. 1987, p. 3765), and an Act approved August 17, 2001 (Ga.
L. 2001 Ex. Sess., p. 203), so as to provide for the appointment of the judges
of such court; to repeal conflicting laws; and for other purposes.

IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act creating the Recorder's Court of Gwinnett County, approved March 27, 1972
(Ga. L. 1972, p. 3125), as amended, particularly by an Act approved March 5,
1987 (Ga. L. 1987, p. 3765), and an Act approved August 17, 2001 (Ga. L. 2001
Ex. Sess., p. 203), is amended by deleting Section 5A and revising Section 5 as
follows:
"SECTION
5.
(a)
There shall be three judges of the recorder's court appointed by a majority vote
of the judges of the State Court of Gwinnett County. Each judge appointed shall
serve for a term of four years and until a successor is appointed and qualified.
All vacancies occurring in such offices shall be filled in like manner, for the
remainder of the unexpired term.
(b)
The judge of the recorder's court senior in length of continuous service as a
recorder's court judge shall be chief judge. The chief judge shall be
responsible for the administration and expeditious disposition of the business
of the court and shall have power to make such rules as he or she shall deem
necessary or proper for such purpose but not in conflict with the general laws
of this state. The rules of the chief judge shall be binding on the other
judges of the recorder's court.
(c)
The judges of the recorder's court serving on the effective date of this Act
shall continue to serve for the remainder of their terms and until successors
are duly appointed and qualified."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
