The House Committee on Judiciary offers the following substitute to SB 257:

A BILL TO BE ENTITLED
AN ACT

To amend Article 2 of Chapter 62A of Title 36 of the Official Code of Georgia Annotated, relating to development authorities, so as to clarify that development authorities are authorized to conduct redevelopment; to modify provisions related to mandatory initial and continuing training for directors and members of development authorities; to provide for related matters; to provide for an effective date and applicability; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
Article 2 of Chapter 62A of Title 36 of the Official Code of Georgia Annotated, relating to development authorities, is amended by revising Code Section 36-62A-20, relating to the definition of a development authority, as follows:
"36-62A-20.
As used in this article, the term 'development authority' means any authority created by law or by constitutional amendment for one or more counties or municipalities, or any combination thereof, for the purpose of promoting the development or redevelopment of trade, commerce, industry, and employment opportunities or for other purposes. Without limiting the generality of the foregoing, such term shall specifically include all authorities created pursuant to Chapter 62 of this title."

SECTION 2.
Said article is further amended by revising Code Section 36-62A-21, relating to required training on development and redevelopment programs, as follows:
"36-62A-21.
Except for a director who is also a member of the governing body of a municipal corporation or county, each director or member of the governing board or body of a development authority shall attend and complete at least eight hours of training on development and redevelopment programs for development authorities within the first 12 months of the director's or member's initial appointment, including an appointment after an interruption in service, to the development authority. Directors and members in office on January 1, 2000, shall be exempt from this requirement unless reappointed for an additional term. In addition, each such director or member reappointed to the governing board or body of a development authority shall complete at least eight hours of advanced training on development and redevelopment programs for development authorities within 12 months of each reappointment. A director or member of a development authority who is not in compliance with the requirements of this Code section shall be ineligible to serve as an officer of such development authority."

SECTION 3.
This Act shall become effective on July 1, 2012, and shall apply to appointments and reappointments made on or after such date.

SECTION 4.
All laws and parts of laws in conflict with this Act are repealed.
