A BILL TO BE ENTITLED
AN ACT

To amend Code Section 2-2-9.1 of the Official Code of Georgia Annotated, relating to the administrative authority of the Commissioner of Agriculture on hearings for individuals adversely affected, so as to clarify the timing of the Commissioner's final decision and decision for reconsideration of the final decision; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.

Code Section 2-2-9.1 of the Official Code of Georgia Annotated, relating to the administrative authority of the Commissioner of Agriculture on hearings for individuals adversely affected, is amended by revising paragraph (2) of subsection (l) and paragraph (6) of subsection (m) as follows:

"(2) The Commissioner's final decision must shall be rendered not later than 30 days following the date the initial decision was issued from the date of the filing of an application for final agency review unless such period is extended pursuant to paragraph (4) of this subsection."

"(6) The Commissioner's reconsideration decision shall be rendered within 30 days following the latest filing deadline."

SECTION 2.

All laws and parts of laws in conflict with this Act are repealed.
