A BILL TO BE ENTITLED
AN ACT


To amend an Act to create the Catoosa County Public Works Authority, approved April 10, 1998 (Ga. L. 1998, p. 4302), as amended, particularly by an Act approved May 1, 2000 (Ga. L. 2000, p. 4585), so as to change the composition of the authority; to change the manner of compensating such authority; to provide for terms of office, filling of vacancies, and removal from office; to provide that meetings of the authority shall be called by the Board of Commissioners of Catoosa County; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.
An Act to create the Catoosa County Public Works Authority, approved April 10, 1998 (Ga. L. 1998, p. 4302), as amended, particularly by an Act approved May 1, 2000 (Ga. L. 2000, p. 4585), is amended by revising subsections (b) and (c) of Section 2 as follows:

"(b) The members of the Catoosa County Public Works Authority in office on the effective date of this Act shall serve until June 30, 2009, and then their terms shall end. On and after July 1, 2009, the Catoosa County Public Works Authority shall consist of five members appointed by the Board of Commissioners of Catoosa County. Each member shall be a legal resident and registered elector of Catoosa County. Such members shall serve for terms of one year and until their successors are appointed and qualified. The first members of the reconstituted authority shall take office on July 1, 2009, and shall serve until June 30, 2010, and until their successors are appointed and qualified. Successors to such members shall be appointed annually and shall take office on July 1 of each year. Any vacancy shall be filled by appointment of the Board of Commissioners of Catoosa County for the unexpired term of office. The members of the authority shall be authorized to select from their number a person to serve as chairperson and shall be authorized to further organize themselves and to elect such other officers from among their number as they deem appropriate. The authority shall meet on the call of the Board of Commissioners of Catoosa County. Members of the authority may be removed from office at any time for any reason by the Board of Commissioners of Catoosa County.
(c) The compensation and expense reimbursement for members of the authority, if any, shall be established by the Board of Commissioners of Catoosa County. No member or employee of the authority shall have directly or indirectly any financial interest, profit, or benefit in any contract, work, or business of the authority nor in the sale, lease, or purchase of any property to or from the authority."

SECTION 2.
All laws and parts of laws in conflict with this Act are repealed.
