BILL TO BE ENTITLED
AN ACT
To
amend an Act creating a Magistrate's Court of Rockdale County, approved March
13, 1978 (Ga. L. 1978, p. 3907), as amended, so as to provide for the election
of the chief magistrate of the Magistrate Court of Rockdale County; to provide
for the filling of vacancies; to provide for the nonpartisan election of the
chief magistrate; to provide for submission of the Act for preclearance; to
provide for related matters; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act creating a Magistrate's Court of Rockdale County, approved March 13, 1978
(Ga. L. 1978, p. 3907), as amended, is amended by revising Section 5 to read as
follows:
"SECTION
5.
(a)
The chief magistrate of Rockdale County shall be elected in accordance with the
provisions of Code Section 15-10-20 of the O.C.G.A. Vacancies in such office
shall be filled in accordance with the provisions of Code Section 15-10-20 of
the O.C.G.A.
(b)
All elections shall be nonpartisan as provided for in Code Section 21-2-139 of
the O.C.G.A. and shall be conducted as provided in Chapter 2 of Title 21 of the
O.C.G.A., the 'Georgia Election Code.'"
SECTION
2.
The
governing authority of Rockdale County shall, through its legal counsel, cause
this Act to be submitted for preclearance pursuant to Section 5 of the federal
Voting Rights Act of 1965, as amended, within 60 days after the date that this
Act is approved by the Governor or otherwise becomes law without such
approval.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
