BILL TO BE ENTITLED
AN ACT
To
amend an Act to provide for the Magistrate Court of Fayette County, approved
April 1, 1983 (Ga. L. 1983, p. 4707), as amended by an Act approved March 19,
1987 (Ga. L. 1987, 4406), so as to modify the qualifications and the salary of
the magistrate court judges of Fayette County; to provide for an effective date;
to repeal conflicting laws; and for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
An
Act to provide for the Magistrate Court of Fayette County, approved April 1,
1983 (Ga. L. 1983, p. 4707), as amended by an Act approved March 19, 1987 (Ga.
L. 1987, 4406), is amended by adding a new subsection to Section 4 to read as
follows:
"(e)
No person shall be judge of the magistrate court unless, at the time of his or
her election, he or she has attained the age of 25 years, has been a citizen of
the state for three years, has practiced law for seven years, and has been duly
reinstated to the practice of law in the event of his or her disbarment
therefrom, or has served as a judge of the Magistrate Court of Fayette County in
good standing for seven or more years."
SECTION
2.
Said
Act is further amended by revising Section 4 to read as follows:
"(a)
The chief judge of the Magistrate Court of Fayette County shall receive as
compensation an amount equal to 17 percent of the base salary of a judge in the
superior courts for the State of Georgia plus any supplement which may be
provided by the County. Such compensation shall be paid in equal monthly
installments from the funds of Fayette County.
(b)
All other judges of the Magistrate Court of Fayette County shall receive as
compensation an amount equal to 14 percent of the base salary of a judge in the
superior courts for the State of Georgia plus any supplement which may be
provided by the County. Such compensation shall be paid in equal monthly
installments from the funds of Fayette County."
SECTION
3.
This
Act shall become effective on July 1, 2011.
SECTION
4.
All
laws and parts of laws in conflict with this Act are repealed.
