BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Code Section 40-6-184 of the Official Code of Georgia Annotated, relating
to impeding the flow of traffic, so as to provide for a minimum fine for
impeding traffic flow; to provide for related matters; to provide for an
effective date and applicability; to repeal conflicting laws; and for other
purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Code
Section 40-6-184 of the Official Code of Georgia Annotated, relating to impeding
the flow of traffic, is amended by revising subsection (a) as
follows:
"(a)(1)
No person shall drive a motor vehicle at such a slow speed as to impede the
normal and reasonable movement of traffic, except when reduced speed is
necessary for safe operation.
(2)
On roads, streets, or highways with two or more lanes allowing for movement in
the same direction, no person shall continue to operate a motor vehicle in the
most left-hand lane at less than the maximum lawful speed limit once such person
knows or should reasonably know that he
or
she is being overtaken in such lane from
the rear by a motor vehicle traveling at a higher rate of speed, except when
such motor vehicle is preparing for a left turn.
This
subsection shall not apply to managed lanes.
(3)
Any conviction for a violation of the provisions of this subsection shall be
punishable by a minimum fine of $75.00 in addition to any other punishment
authorized by law."
SECTION
2.
This
Act shall become effective on July 1, 2010, and be applicable to any offenses
committed on or after that date.
SECTION
3.
All
laws and parts of laws in conflict with this Act are repealed.
