    1                        A bill to be entitled                      
    2         An act relating to a review under the Open Government
    3         Sunset Review Act; amending s. 339.55, F.S., relating
    4         to an exemption from public records requirements for
    5         financial information of a private entity applicant
    6         which the Department of Transportation requires as
    7         part of a certain application process; removing the
    8         scheduled repeal of the exemption; providing an
    9         effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (10) of section 339.55, Florida
   14  Statutes, is amended to read:
   15         339.55 State-funded infrastructure bank.—
   16         (10)(a) Financial information of a private entity applicant
   17  which the department requires as part of the application process
   18  for loans or credit enhancements from the state-funded
   19  infrastructure bank is exempt from s. 119.07(1) and s. 24(a),
   20  Art. I of the State Constitution. This exemption does not apply
   21  to records of an applicant who is in default of a loan issued
   22  under this section. As used in this subsection, the term
   23  “financial information” means any business plan, pro forma
   24  statement, account balance, operating income or revenue, asset
   25  value, or debt of the applicant.
   26         (b) This subsection is subject to the Open Government
   27  Sunset Review Act in accordance with s. 119.15 and shall stand
   28  repealed on October 2, 2021, unless reviewed and saved from
   29  repeal through reenactment by the Legislature.
   30         Section 2. This act shall take effect October 1, 2021.
