    1                        A bill to be entitled                      
    2         An act relating to trust funds; amending s. 20.195,
    3         F.S.; creating the Child Care Trust Fund within the
    4         Department of Children and Families; providing the
    5         purpose of the trust fund; providing for future review
    6         and termination or re-creation of the trust fund;
    7         providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (11) is added to section 20.195,
   12  Florida Statutes, to read:
   13         20.195 Department of Children and Families; trust funds.
   14  The following trust funds shall be administered by the
   15  Department of Children and Families:
   16         (11) Child Care Trust Fund.
   17         (a) The Child Care Trust Fund is created within the
   18  Department of Children and Families. Funds credited to the trust
   19  fund shall be used for universal daycare and preschool credits
   20  to completely fund or reduce the cost of childcare services for
   21  parents and for other such purposes as may be appropriate.
   22         (b) Notwithstanding the provisions of s. 216.301 and
   23  pursuant to s. 216.351, any balance in the trust fund at the end
   24  of any fiscal year shall remain in the trust fund at the end of
   25  the year and shall be available for carrying out the purposes of
   26  the trust fund.
   27         (c) In accordance with s. 19(f)(2), Art. III of the State
   28  Constitution, the Child Care Trust Fund shall, unless terminated
   29  sooner, be terminated on July 1, 2025. Before its scheduled
   30  termination, the trust fund shall be reviewed as provided in s.
   31  215.3206(1) and (2).
   32         Section 2. This act shall take effect on the same date that
   33  SB ___ or similar legislation takes effect, if such legislation
   34  is adopted in the same legislative session or an extension
   35  thereof and becomes a law.
