    1                        A bill to be entitled                      
    2         An act relating to search warrants; amending s.
    3         933.14, F.S.; deleting a provision prohibiting the
    4         return of a pistol or firearm taken by any officer,
    5         with or without a search warrant, upon a view by the
    6         officer of a breach of the peace; deleting an
    7         exception; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (3) of section 933.14, Florida
   12  Statutes, is amended to read:
   13         933.14 Return of property taken under search warrant.—
   14         (3) No pistol or firearm taken by any officer with a search
   15  warrant or without a search warrant upon a view by the officer
   16  of a breach of the peace shall be returned except pursuant to an
   17  order of a trial court judge.
   18         Section 2. This act shall take effect upon becoming a law.
