    1                        A bill to be entitled                      
    2         An act relating to the preemption of over-the-counter
    3         drugs and cosmetics; amending s. 499.002, F.S.;
    4         deleting a provision preempting the regulation of
    5         over-the-counter proprietary drugs and cosmetics to
    6         the state; providing an effective date.

    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Subsection (7) of section 499.002, Florida
   11  Statutes, is amended to read:
   12         499.002 Purpose, administration, and enforcement of and
   13  exemption from this part.—
   14         (7) Notwithstanding any other law or local ordinance or
   15  regulation to the contrary, the regulation of over-the-counter
   16  proprietary drugs and cosmetics is expressly preempted to the
   17  state.
   18         Section 2. This act shall take effect July 1, 2021.
