Florida Senate - 2021 CS for SB 1094 By the Committee on Education; and Senator Bean 581-03258-21 20211094c1 1 A bill to be entitled 2 An act relating to required health education 3 instruction; amending s. 1003.42, F.S.; providing 4 additional requirements for health education; revising 5 the grade levels when students receive certain health 6 education instruction; requiring health education 7 instruction to include prevention of specified harms; 8 requiring such education to include an awareness of 9 the benefits of sexual abstinence as the expected 10 standard and the consequences of teenage pregnancy; 11 amending s. 1006.148, F.S.; conforming a cross 12 reference; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida: 15 16 Section 1. Paragraph (n) of subsection (2) of section 17 1003.42, Florida Statutes, is amended to read: 18 1003.42 Required instruction.— 19 (2) Members of the instructional staff of the public 20 schools, subject to the rules of the State Board of Education 21 and the district school board, shall teach efficiently and 22 faithfully, using the books and materials required that meet the 23 highest standards for professionalism and historical accuracy, 24 following the prescribed courses of study, and employing 25 approved methods of instruction, the following: 26 (n)1. Comprehensive age-appropriate and developmentally 27 appropriate K-12 health education that addresses concepts of 28 community health,;consumer health,;environmental health, and;29 family life, including: 30 a.An awareness of the benefits of sexual abstinence as the31expected standard and the consequences of teenage pregnancy;32 Mental and emotional health.;33 b. Injury prevention and safety.;34 c. Internet safety.;35 d. Nutrition.;36 e. Personal health.;37 f. Prevention and control of disease.; and38 g. Substance use and abuse. 39 h. Prevention of child sexual abuse, exploitation, and 40 human trafficking. 41 2. The health education curriculum for students in grades 7 42 through 12 shall include a teen dating violence and abuse 43 component that includes, but is not limited to, the definition 44 of dating violence and abuse, the warning signs of dating 45 violence and abusive behavior, the characteristics of healthy 46 relationships, measures to prevent and stop dating violence and 47 abuse, and community resources available to victims of dating 48 violence and abuse. 49 3. The health education curriculum for students in grades 6 50 through 12 shall include an awareness of the benefits of sexual 51 abstinence as the expected standard and the consequences of 52 teenage pregnancy. 53 54 The State Board of Education is encouraged to adopt standards 55 and pursue assessment of the requirements of this subsection. A 56 character development program that incorporates the values of 57 the recipients of the Congressional Medal of Honor and that is 58 offered as part of a social studies, English Language Arts, or 59 other schoolwide character building and veteran awareness 60 initiative meets the requirements of paragraphs (s) and (t). 61 Section 2. Paragraph (c) of subsection (1) of section 62 1006.148, Florida Statutes, is amended to read: 63 1006.148 Dating violence and abuse prohibited.— 64 (1) Each district school board shall adopt and implement a 65 dating violence and abuse policy. The policy shall: 66 (c) Define dating violence and abuse and provide for a teen 67 dating violence and abuse component in the health education 68 curriculum, according to s. 1003.42(2)(n)2.s. 1003.42(2)(n), 69 with emphasis on prevention education. 70 Section 3. This act shall take effect July 1, 2021.
