    1                        A bill to be entitled                      
    2         An act relating to uterine fibroid research and
    3         education; creating s. 381.9312, F.S.; providing
    4         definitions; requiring the Department of Health to
    5         develop and maintain an electronic database of
    6         information related to uterine fibroids; providing a
    7         specified purpose for such database; requiring that
    8         the database include specified information; requiring
    9         health care providers to submit certain information to
   10         the department for inclusion in the database;
   11         prohibiting the database from including any personal
   12         identifying information; requiring the department to
   13         develop and include information related to uterine
   14         fibroids in certain literature currently made
   15         available to the public for a specified purpose;
   16         providing appropriations and authorizing a position;
   17         providing an effective date.
   18          
   19  Be It Enacted by the Legislature of the State of Florida:
   20  
   21         Section 1. Section 381.9312, Florida Statutes, is created
   22  to read:
   23         381.9312 Uterine fibroid research database; education and
   24  public awareness.—
   25         (1) DEFINITIONS.—As used in this section, the term:
   26         (a) “Department” means the Department of Health.
   27         (b) “Health care provider” means a physician or physician
   28  assistant licensed under chapter 458 or chapter 459 or an
   29  advanced practice registered nurse licensed under chapter 464.
   30         (c) “Uterine fibroid” means a noncancerous growth of the
   31  uterus that often appears during a woman’s childbearing years.
   32         (2) UTERINE FIBROID RESEARCH DATABASE.—
   33         (a) The department shall develop and maintain an electronic
   34  database consisting of information related to uterine fibroids.
   35  The purpose of the database is to encourage research relating to
   36  the diagnosis and treatment of uterine fibroids and to ensure
   37  that women are provided with the relevant information and health
   38  care necessary to prevent and treat uterine fibroids. The
   39  database must include, but need not be limited to, all of the
   40  following information:
   41         1. Incidence and prevalence of women diagnosed with uterine
   42  fibroids in this state.
   43         2. Demographic attributes of women diagnosed with uterine
   44  fibroids in this state.
   45         3. Treatments and procedures for uterine fibroids used by
   46  health care providers in this state.
   47         (b) A health care provider who diagnoses or treats a woman
   48  with uterine fibroids shall submit information relating to such
   49  diagnosis or treatment to the department in a form and manner
   50  prescribed by department rule for inclusion in the database.
   51  Such information may be submitted along with any reports or
   52  other information that the health care provider is required to
   53  submit to the department pursuant to state law.
   54         (c) The database may not include any personal identifying
   55  information of women diagnosed with or treated for uterine
   56  fibroids.
   57         (3) UTERINE FIBROID EDUCATION OUTREACH AND PUBLIC
   58  AWARENESS.—The department shall develop and include information
   59  related to uterine fibroids in its women’s health care
   60  educational materials currently made available to the public.
   61  The information must include, but need not be limited to, the
   62  following:
   63         (a) Possible risk factors for developing uterine fibroids.
   64         (b) Range of available treatment options that are
   65  considered alternatives to hysterectomy.
   66         Section 2. For the 2022-2023 fiscal year, the sums of
   67  $121,852 in recurring funds and $681,048 in nonrecurring funds
   68  from the General Revenue Fund are appropriated to the Department
   69  of Health and one full-time equivalent position with associated
   70  salary rate of 55,212 is authorized for the purpose of
   71  implementing this act.
   72         Section 3. This act shall take effect July 1, 2022.
