    1                        A bill to be entitled                      
    2         An act relating to anatomical gifts; amending s.
    3         765.521, F.S.; requiring an applicant for a driver
    4         license, driver license renewal, or identification
    5         card to provide a statement of whether he or she
    6         agrees to have his or her name included in the donor
    7         registry; specifying the options that may be selected
    8         by an applicant in his or her statement; providing an
    9         effective date.
   10          
   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Present subsections (2) and (3) of section
   14  765.521, Florida Statutes, are redesignated as subsections (3)
   15  and (4), respectively, and a new subsection (2) is added to that
   16  section, to read:
   17         765.521 Donations as part of driver license or
   18  identification card process.—
   19         (2) An applicant for a driver license under s. 322.08, a
   20  driver license renewal under s. 322.18, or an identification
   21  card under s. 322.051 shall provide a statement in writing, or
   22  by other means approved by the department, of whether he or she
   23  agrees to have his or her name included in the donor registry by
   24  responding to one of the following three options provided by the
   25  department: “Yes,” “No,” or “Defer to family wishes.” A person
   26  who chooses:
   27         (a) “Yes” has agreed to have his or her name included in
   28  the donor registry and has entered into a legally binding
   29  commitment to donate his or her organs or tissue upon his or her
   30  death.
   31         (b) “No” has not agreed to have his or her name included in
   32  the donor registry.
   33         (c) “Defer to family wishes” has agreed to allow a person
   34  listed in s. 765.512(3) to donate all or any part of the
   35  decedent’s body for any purpose specified in s. 765.513.
   36         Section 2. This act shall take effect July 1, 2015.
