    1                        A bill to be entitled                      
    2         An act relating to the identification of underground
    3         facilities; amending s. 556.101, F.S.; deleting a
    4         preemption to the state for the regulation of the
    5         types of paint or marking device or the removal of
    6         such marks that are used to identify underground
    7         facilities; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Paragraph (d) of subsection (3) of section
   12  556.101, Florida Statutes, is amended to read:
   13         556.101 Short title; legislative intent.—
   14         (3) It is the purpose of this chapter to:
   15         (d) Reserve to the state the power to regulate any subject
   16  matter specifically addressed in this chapter. Municipalities,
   17  counties, districts, or other local governments may not adopt or
   18  enforce ordinances or rules that conflict with this chapter or
   19  that prescribe either any of the following:
   20         1. Require operators of underground facilities to obtain
   21  permits from local governments in order to identify underground
   22  facilities.
   23         2. Require premarking or marking.
   24         3. Specify the types of paint or other marking devices that
   25  are used to identify underground facilities.
   26         4. Require removal of marks.
   27         Section 2. This act shall take effect July 1, 2020.
