    1                        A bill to be entitled                      
    2         An act relating to sentencing; amending s. 893.13,
    3         F.S.; reducing the distance applicable to certain
    4         controlled substance offenses committed within certain
    5         drug-free zones; providing that only offenses
    6         involving the sale or manufacturing of a controlled
    7         substance are subject to enhanced penalties when
    8         committed within a drug-free zone; amending s.
    9         921.0022, F.S.; conforming provisions to changes made
   10         by the act; providing an effective date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Paragraphs (c), (d), (e), (f), and (h) of
   15  subsection (1) of section 893.13, Florida Statutes, are amended
   16  to read:
   17         893.13 Prohibited acts; penalties.—
   18         (1)
   19         (c) Except as authorized by this chapter, a person may not
   20  sell or, manufacture, or deliver, or possess with intent to
   21  sell, manufacture, or deliver, a controlled substance in, on, or
   22  within 1,000 feet of the real property comprising a child care
   23  facility as defined in s. 402.302 or a public or private
   24  elementary, middle, or secondary school between the hours of 6
   25  a.m. and 12 midnight, or at any time in, on, or within 250 1,000
   26  feet of real property comprising a state, county, or municipal
   27  park, a community center, or a publicly owned recreational
   28  facility. As used in this paragraph, the term “community center”
   29  means a facility operated by a nonprofit community-based
   30  organization for the provision of recreational, social, or
   31  educational services to the public. A person who violates this
   32  paragraph with respect to:
   33         1. A controlled substance named or described in s.
   34  893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4.
   35  commits a felony of the first degree, punishable as provided in
   36  s. 775.082, s. 775.083, or s. 775.084. The defendant must be
   37  sentenced to a minimum term of imprisonment of 3 calendar years
   38  unless the offense was committed within 1,000 feet of the real
   39  property comprising a child care facility as defined in s.
   40  402.302.
   41         2. A controlled substance named or described in s.
   42  893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)5., (2)(c)6.,
   43  (2)(c)7., (2)(c)8., (2)(c)9., (3), or (4) commits a felony of
   44  the second degree, punishable as provided in s. 775.082, s.
   45  775.083, or s. 775.084.
   46         3. Any other controlled substance, except as lawfully sold
   47  or, manufactured, or delivered, must be sentenced to pay a $500
   48  fine and to serve 100 hours of public service in addition to any
   49  other penalty prescribed by law.

   51  This paragraph does not apply to a child care facility unless
   52  the owner or operator of the facility posts a sign that is not
   53  less than 2 square feet in size with a word legend identifying
   54  the facility as a licensed child care facility and that is
   55  posted on the property of the child care facility in a
   56  conspicuous place where the sign is reasonably visible to the
   57  public.
   58         (d) Except as authorized by this chapter, a person may not
   59  sell or, manufacture, or deliver, or possess with intent to
   60  sell, manufacture, or deliver, a controlled substance in, on, or
   61  within 250 1,000 feet of the real property comprising a public
   62  or private college, university, or other postsecondary
   63  educational institution. A person who violates this paragraph
   64  with respect to:
   65         1. A controlled substance named or described in s.
   66  893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4.
   67  commits a felony of the first degree, punishable as provided in
   68  s. 775.082, s. 775.083, or s. 775.084.
   69         2. A controlled substance named or described in s.
   70  893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)5., (2)(c)6.,
   71  (2)(c)7., (2)(c)8., (2)(c)9., (3), or (4) commits a felony of
   72  the second degree, punishable as provided in s. 775.082, s.
   73  775.083, or s. 775.084.
   74         3. Any other controlled substance, except as lawfully sold
   75  or, manufactured, or delivered, must be sentenced to pay a $500
   76  fine and to serve 100 hours of public service in addition to any
   77  other penalty prescribed by law.
   78         (e) Except as authorized by this chapter, a person may not
   79  sell or, manufacture, or deliver, or possess with intent to
   80  sell, manufacture, or deliver, a controlled substance not
   81  authorized by law in, on, or within 1,000 feet of a physical
   82  place for worship at which a church or religious organization
   83  regularly conducts religious services or within 250 1,000 feet
   84  of a convenience business as defined in s. 812.171. A person who
   85  violates this paragraph with respect to:
   86         1. A controlled substance named or described in s.
   87  893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4.
   88  commits a felony of the first degree, punishable as provided in
   89  s. 775.082, s. 775.083, or s. 775.084.
   90         2. A controlled substance named or described in s.
   91  893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)5., (2)(c)6.,
   92  (2)(c)7., (2)(c)8., (2)(c)9., (3), or (4) commits a felony of
   93  the second degree, punishable as provided in s. 775.082, s.
   94  775.083, or s. 775.084.
   95         3. Any other controlled substance, except as lawfully sold
   96  or, manufactured, or delivered, must be sentenced to pay a $500
   97  fine and to serve 100 hours of public service in addition to any
   98  other penalty prescribed by law.
   99         (f) Except as authorized by this chapter, a person may not
  100  sell or, manufacture, or deliver, or possess with intent to
  101  sell, manufacture, or deliver, a controlled substance in, on, or
  102  within 250 1,000 feet of the real property comprising a public
  103  housing facility at any time. As used in this section, the term
  104  “real property comprising a public housing facility” means real
  105  property, as defined in s. 421.03(12), of a public corporation
  106  created as a housing authority pursuant to part I of chapter
  107  421. A person who violates this paragraph with respect to:
  108         1. A controlled substance named or described in s.
  109  893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4.
  110  commits a felony of the first degree, punishable as provided in
  111  s. 775.082, s. 775.083, or s. 775.084.
  112         2. A controlled substance named or described in s.
  113  893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)5., (2)(c)6.,
  114  (2)(c)7., (2)(c)8., (2)(c)9., (3), or (4) commits a felony of
  115  the second degree, punishable as provided in s. 775.082, s.
  116  775.083, or s. 775.084.
  117         3. Any other controlled substance, except as lawfully sold
  118  or, manufactured, or delivered, must be sentenced to pay a $500
  119  fine and to serve 100 hours of public service in addition to any
  120  other penalty prescribed by law.
  121         (h) Except as authorized by this chapter, a person may not
  122  sell or, manufacture, or deliver, or possess with intent to
  123  sell, manufacture, or deliver, a controlled substance in, on, or
  124  within 1,000 feet of the real property comprising an assisted
  125  living facility, as that term is used in chapter 429. A person
  126  who violates this paragraph with respect to:
  127         1. A controlled substance named or described in s.
  128  893.03(1)(a), (1)(b), (1)(d), (2)(a), (2)(b), or (2)(c)4.
  129  commits a felony of the first degree, punishable as provided in
  130  s. 775.082, s. 775.083, or s. 775.084.
  131         2. A controlled substance named or described in s.
  132  893.03(1)(c), (2)(c)1., (2)(c)2., (2)(c)3., (2)(c)5., (2)(c)6.,
  133  (2)(c)7., (2)(c)8., (2)(c)9., (3), or (4) commits a felony of
  134  the second degree, punishable as provided in s. 775.082, s.
  135  775.083, or s. 775.084.
  136         3. Any other controlled substance, except as lawfully sold
  137  or, manufactured, or delivered, must be sentenced to pay a $500
  138  fine and to serve 100 hours of public service in addition to any
  139  other penalty prescribed by law.
  140         Section 2. Paragraphs (c), (e), and (g) of subsection (3)
  141  of section 921.0022, Florida Statutes, are amended to read:
