    1                        A bill to be entitled                      
    2         An act relating to construction materials mining
    3         activities; amending s. 552.30, F.S.; specifying a
    4         ground vibration limit for construction materials
    5         mining activities within 1 mile of certain areas;
    6         authorizing the State Fire Marshal to modify the
    7         standards, limits, and regulations for the use of
    8         explosives in connection with such construction
    9         materials mining activities; providing an effective
   10         date.
   11          
   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (4) is added to section 552.30,
   15  Florida Statutes, to read:
   16         552.30 Construction materials mining activities.—
   17         (4)(a)Beginning July 1, 2023, and notwithstanding any
   18  other law, rule, or ordinance, the ground vibration limit for
   19  construction materials mining activities within 1 mile of
   20  residentially zoned areas may not exceed 0.15 inches per second.
   21         (b)Notwithstanding this section or any other law, the
   22  State Fire Marshal may modify the standards, limits, and
   23  regulations for the use of explosives in connection with
   24  construction materials mining activities within 1 mile of
   25  residentially zoned areas, including, but not limited to, the
   26  temporary cessation of blasting.
   27         Section 2. This act shall take effect July 1, 2023.
