A bill to be entitled
2An act relating to instructional materials for public
3school education; amending s. 1006.282, F.S.;
4correcting a cross-reference; amending ss. 1006.37 and
51006.38, F.S.; revising the period of time for the
6requisition and maintenance of inventory of
7instructional materials for certain core courses;
8amending s. 1006.40, F.S.; revising the period of time
9for the purchase of instructional materials for
10certain core courses; revising requirements relating
11to the use of the instructional materials allocation
12for the purchase of materials not on the state-adopted
13list; providing an effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Subsection (3) of section 1006.282, Florida
18Statutes, is amended to read:
19     1006.282  Pilot program for the transition to electronic
20and digital instructional materials.-
21     (3)  A school designated as a pilot program school by the
22school board is exempt from:
23     (a)  Section 1006.40(3)(a) 1006.40(2)(a), if the school
24provides comprehensive electronic or digital instructional
25materials to all students; and
26     (b)  Section 1006.37.
27     Section 2.  Subsection (1) of section 1006.37, Florida
28Statutes, is amended to read:
29     1006.37  Requisition of instructional materials from
30publisher's depository.-
31     (1)  The district school superintendent shall requisition
32adopted instructional materials from the depository of the
33publisher with whom a contract has been made. However, the
34superintendent shall requisition current instructional materials
35to provide each student with a textbook or other materials as a
36major tool of instruction in core courses of the subject areas
37specified in s. 1006.40(2). These materials must be
38requisitioned within the first 4 2 years of the adoption cycle,
39except for instructional materials related to growth of student
40membership or instructional materials maintenance needs. The
41superintendent may requisition instructional materials in the
42core subject areas specified in s. 1006.40(2) that are related
43to growth of student membership or instructional materials
44maintenance needs during the 3rd, 4th, 5th year, and 6th years
45of the original contract period.
46     Section 3.  Subsections (12) and (13) of section 1006.38,
47Florida Statutes, are amended to read:
48     1006.38  Duties, responsibilities, and requirements of
49instructional materials publishers and manufacturers.-Publishers
50and manufacturers of instructional materials, or their
51representatives, shall:
52     (12)  For the core subject areas specified in s.
531006.40(2), maintain in the depository for the first 4 2 years
54of the contract an inventory of instructional materials
55sufficient to receive and fill orders.
56     (13)  For the core subject areas specified in s.
571006.40(2), ensure the availability of an inventory sufficient
58to receive and fill orders for instructional materials for
59growth, including the opening of a new school, and replacement
60during the 5th year 3rd and subsequent years of the original
61contract period.
62     Section 4.  Subsections (2) and (4) of section 1006.40,
63Florida Statutes, are amended to read:
64     1006.40  Use of instructional materials allocation;
65instructional materials, library books, and reference books;
66repair of books.-
67     (2)  Each district school board must purchase current
68instructional materials to provide each student with a major
69tool of instruction in core courses of the subject areas of
70mathematics, language arts, science, social studies, reading,
71and literature for kindergarten through grade 12. Such purchase
72must be made within the first 4 2 years after the effective date
73of the adoption cycle.
74     (4)  The funds described in subsection (3) which district
75school boards may use to purchase materials not on the state-
76adopted list shall be used for the purchase of instructional
77materials or other items having intellectual content that is
78aligned to the Next Generation Sunshine State Standards. These
79instructional materials or other items shall be used instead of
80instructional materials on the state-adopted list which provide
81instruction in the core courses pursuant to subsection (2) which
82assist in the instruction of a subject or course. These
83instructional materials or other items may be available in
84bound, unbound, kit, or package form and may consist of
85hardbacked or softbacked textbooks, electronic content,
86replacements for items which were part of previously purchased
87instructional materials, consumables, learning laboratories,
88manipulatives, electronic media, computer courseware or
89software, and other commonly accepted instructional tools as
90prescribed by district school board rule.
91     Section 5.  This act shall take effect July 1, 2012.
