1	A bill to be entitled
2	An act relating to landfills; amending s. 403.708, F.S.;
3	authorizing specified landfills to accept yard trash for
4	disposal; providing an effective date.

6	Be It Enacted by the Legislature of the State of Florida:

8	Section 1. Paragraph (c) of subsection (12) of section
9	403.708, Florida Statutes, is amended to read:
10	403.708 Prohibition; penalty.-
11	(12) A person who knows or should know of the nature of
12	the following types of solid waste may not dispose of such solid
13	waste in landfills:
14	(c) Yard trash in lined landfills classified by department
15	rule as Class I landfills. However, Class I landfills that are
16	designed to utilize an active gas collection system to collect
17	landfill gas generated at the Class I disposal facility and that
18	provide or arrange for reuse of the landfill gas collected may
19	accept yard trash for disposal. Yard trash that is source
20	separated from solid waste may be accepted at a solid waste
21	disposal area where separate yard trash composting facilities
22	are provided and maintained. The department recognizes that
23	incidental amounts of yard trash may be disposed of in Class I
24	landfills. In any enforcement action taken pursuant to this
25	paragraph, the department shall consider the difficulty of
26	removing incidental amounts of yard trash from a mixed solid
27	waste stream.
28	Section 2. This act shall take effect July 1, 2010.
