A bill to be entitled
2An act relating to assault or battery on utility workers;
3amending s. 784.07, F.S.; defining the term "utility
4worker"; providing for reclassification of certain
5offenses against utility workers; reenacting and amending
6s. 921.0022(3)(d), (f), and (g), F.S., relating to the
7offense severity ranking chart of the Criminal Punishment
8Code, to incorporate the amendments made to s. 784.07,
9F.S., in references thereto; providing an effective date.

11Be It Enacted by the Legislature of the State of Florida:
12
13     Section 1.  Paragraph (f) is added to subsection (1) of
14section 784.07, Florida Statutes, and subsection (2) of that
15section is amended, to read:
16     784.07  Assault or battery of law enforcement officers,
17firefighters, emergency medical care providers, public transit
18employees or agents, or other specified persons officers;
19reclassification of offenses; minimum sentences.-
20     (1)  As used in this section, the term:
21     (f)  "Utility worker" means any person employed by an
22entity that owns, operates, leases, or controls any plant,
23property, or facility for the generation, transmission,
24manufacture, production, supply, distribution, sale, storage,
25conveyance, delivery, or furnishing to or for the public of
26electricity, natural or manufactured gas, water, steam, sewage,
27or telephone service, including two or more utilities rendering
28joint service.
29     (2)  Whenever any person is charged with knowingly
30committing an assault or battery upon a law enforcement officer,
31a firefighter, an emergency medical care provider, a traffic
32accident investigation officer as described in s. 316.640, a
33nonsworn law enforcement agency employee who is certified as an
34agency inspector, a blood alcohol analyst, or a breath test
35operator while such employee is in uniform and engaged in
36processing, testing, evaluating, analyzing, or transporting a
37person who is detained or under arrest for DUI, a law
38enforcement explorer, a traffic infraction enforcement officer
39as described in s. 316.640, a parking enforcement specialist as
40defined in s. 316.640, a person licensed as a security officer
41as defined in s. 493.6101 and wearing a uniform that bears at
42least one patch or emblem that is visible at all times that
43clearly identifies the employing agency and that clearly
44identifies the person as a licensed security officer, or a
45security officer employed by the board of trustees of a
46community college, or a utility worker, while the officer,
47firefighter, emergency medical care provider, traffic accident
48investigation officer, traffic infraction enforcement officer,
49inspector, analyst, operator, law enforcement explorer, parking
50enforcement specialist, public transit employee or agent, or
51security officer, or utility worker is engaged in the lawful
52performance of his or her duties, the offense for which the
53person is charged shall be reclassified as follows:
54     (a)  In the case of assault, from a misdemeanor of the
55second degree to a misdemeanor of the first degree.
56     (b)  In the case of battery, from a misdemeanor of the
57first degree to a felony of the third degree.
58     (c)  In the case of aggravated assault, from a felony of
59the third degree to a felony of the second degree.
60Notwithstanding any other provision of law, any person convicted
61of aggravated assault upon a law enforcement officer shall be
62sentenced to a minimum term of imprisonment of 3 years.
63     (d)  In the case of aggravated battery, from a felony of
64the second degree to a felony of the first degree.
65Notwithstanding any other provision of law, any person convicted
66of aggravated battery of a law enforcement officer shall be
67sentenced to a minimum term of imprisonment of 5 years.
68     Section 2.  For the purpose of incorporating the amendments
69made by this act to section 784.07, Florida Statutes, in
70references thereto, paragraphs (d), (f), and (g) of subsection
71(3) of section 921.0022, Florida Statutes, are reenacted and
72amended to read:
