       Senator Brandes moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Between lines 191 and 192
    4  insert:
    5         Section 3. Subsection (56) of section 316.003, Florida
    6  Statutes, is amended to read:
    7         316.003 Definitions.—The following words and phrases, when
    8  used in this chapter, shall have the meanings respectively
    9  ascribed to them in this section, except where the context
   10  otherwise requires:
   11         (56) PERSONAL DELIVERY DEVICE.—An electrically powered
   12  device that:
   13         (a) Is operated on sidewalks and crosswalks and intended
   14  primarily for transporting property;
   15         (b) Has a weight that does not exceed the maximum weight
   16  established by Department of Transportation rule Weighs less
   17  than 80 pounds, excluding cargo;
   18         (c) Has a maximum speed of 10 miles per hour; and
   19         (d) Is equipped with technology to allow for operation of
   20  the device with or without the active control or monitoring of a
   21  natural person.

   23  A personal delivery device is not considered a vehicle unless
   24  expressly defined by law as a vehicle. A mobile carrier is not
   25  considered a personal delivery device. The Department of
   26  Transportation may adopt rules to implement this subsection.

   32         amending s. 316.003, F.S.; revising the definition of
   33         the term “personal delivery device”; authorizing the
