By December 31, 2013, the Board of Medicine 6 shall adopt rules that allow the provision of health care 7 services to patients via telemedicine. For purposes of 8 rulemaking, telemedicine services include, but are not limited 9 to, the use of interactive audio, video, secure chat, secure 10 email, electronic media, or telephone for the practice of health 11 care delivery, including consultation, diagnosis, treatment, 12 transfer of medical data, or exchange of medical education 13 information by a physician located at a site other than the site 14 of the patient’s location. The rules must address the following: 15 (1) Licensure requirements for the provision of 16 telemedicine services; 17 (2) The requirement that a physician practicing 18 telemedicine be held to the same standard of care as physicians 19 practicing in other care settings; and 20 (3) Requirements for conducting patient evaluations and 21 prescribing legend drugs other than controlled substances via 22 telemedicine. 23 24 ================= T I T L E A M E N D M E N T ================ 25 And the title is amended as follows: 26 Delete line 361 27 and insert: 28 development; requiring the Board of Medicine to adopt 29 rules relating to the provision of health care 30 services via telemedicine; providing an effective 31 date.
