SENATE BILL NO. 332

AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO EMPLOYMENT PRACTICES.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Title 19 of the Delaware Code by adding a new § 709C and by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 709C. Overtime for 9-1-1 Dispatchers.

For purposes of calculating overtime pay, 9-1-1 dispatchers are scheduled based on a regular, pre-established 14-day pay period. Dispatchers must be paid overtime at a rate defined under Federal law for any time worked over 80 hours in the pre-established, 14-day pay period.

SYNOPSIS

Because 9-1-1 dispatchers work mostly 12-hour shifts, they face scheduling difficulties for filling out their 40-hour-work week and covering shifts for sick workers. This Act allows their overtime to be calculated based on a 14-day pay period to give them flexibility in scheduling shifts and covering for sick co-workers.
