AN ACT TO AMEND TITLE 24, CHAPTER 35 OF THE DELAWARE CODE RELATING TO LICENSURE OF PSYCHOLOGISTS. |
Section 1.Amend §3514(a)(2) of Title 24 of the Delaware Code by adding a new subparagraph as follows:
"d. The applicant has not been convicted of a felony sexual offense.".
Section 2.Amend§3914(a)(8) of Title 24 of the Delaware Code by deleting the punctuation "." at the end of the sentence and replacing it with ";" and adding thereafter the following:
(9)Failed to report child abuse or neglect as required by §903 of Title 16, or any successor thereto;
(10)Failed to report to the Board in writing information that the practitioner reasonably believes indicates that any practitioner or healthcare provider is or may be guilty of unprofessional conduct or may be unable to practice their profession with reasonable skill or safety to patients by reason of mental illness or mental incompetence; physical illness, including deterioration through the aging process or loss of motor skill; or excessive use or abuse of drugs, including alcohol.Such written report must be made within 30 days of becoming aware of such information.Any licensee who makes such a report in good faith is not subject to civil damages or criminal prosecution for reporting.".
SYNOPSIS
Section 1 of this bill requires permanent revocation of the license of any person convicted of a felony sexual offense. Section 2 makes it a ground for discipline if a licensee fails to report child abuse or neglect as required of persons licensed in the healing arts by 16 Del. C. §903. |
