SENATE BILL NO. 31

AN ACT TO AMEND TITLE 24, CHAPTER 11 OF THE DELAWARE CODE RELATING TO LICENSURE OF DENTISTS AND DENTAL HYGIENISTS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §1122(c)(4) of Title 24 of the Delaware Code by adding a new subsection as follows:

"d. The applicant has not been convicted of a felony sexual offense.".

Section 2.Amend§1128(4) of Title 24 of the Delaware Code by adding after the sentence that ends with the words and punctuation "dental hygiene." the sentence "The Board shall permanently revoke the certificate to practice dentistry or dental hygiene of a person who is convicted of a felony sexual offense."

Section 3. Amend §1128 of Title 24 of the Delaware Code by adding a new subsection, which shall read as follows:

"(12)Has failed to report child abuse or neglect as required by §903 of Title 16, or any successor thereto.".

Section 4.Amendchapter 11 of Title 24 of the Delaware Code by adding a new section after §1131, as follows:

"§ 1131A.Duty to report.

(a)All persons certified to practice dentistry or dental hygiene shall report to the Board in writing information that such person reasonably believes indicates that any person licensed to practice dentistry or dental hygiene or any other healthcare provider is or may be guilty of unprofessional conduct or may be unable to practice dentistry or dental hygiene with reasonable skill or safety to patients by reason of mental illness or mental incompetence;physical illness, including deterioration through the aging process or loss of motor skill; or excessive use or abuse of drugs, including alcohol.Such written report must be made within 30 days of becoming aware of such information.

(b)Any licensee who makes a report as required by this section who does so in good faith is not subject to civil damages or criminal prosecution for reporting.

(c)Failure to report as required by this section shall be deemed a ground for discipline under §1128 of this Title."



SYNOPSIS

Section 1 of this bill provides that no person who has been convicted of a felony sexual offense can receive a license to practice dentistry or dental hygiene. Section 2 of this bill requires permanent revocation of the license of any person convicted of a felony sexual offense. Section 3 makes it a ground for discipline if a licensee fails to report child abuse or neglect as required of persons licensed in the healing arts by 16 Del. C. §903. Section 4 of this bill requires a licensee to report to the Board any other licensee or healthcare provider who the licensee reasonably believes to be guilty of unprofessional conduct or physically or mentally incapable of practicing their profession.Failure to so report can be grounds for discipline, and any person making a report in good faith is not subject to civil or criminal liability for reporting.
