SENATE SUBSTITUTE NO. 1

FOR

SENATE BILL NO. 239

AN ACT TO AMEND CHAPTER 168, VOLUME 82 OF THE LAWS OF DELAWARE RELATING TO CONTRACTOR REGISTRATION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Three-fifths of all members elected to each house thereof concurring therein):

Section 1. Amend Section 4, Chapter 168, Volume 82 of the Laws of Delaware by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 3605.  Registration required.

(c)(1)a. A contractor who has a State contract under Subchapter IV of Chapter 69 of Title 29 must pay an initial annual non-refundable registration fee of $300 to the Department with the application under this section.

b. The non-refundable registration fee for the second annual registration is $300.

c. Upon successful completion of 2 consecutive years of registration, a contractor may register for a 2-year period and pay a nonrefundable registration fee of $500. The Department may only grant a 2-year registration if the contractor has not violated this chapter or any other labor laws during the registration period that is expiring.

d. A contractor who is performing public work on October 1, 2020, shall submit the registration application form and fee to the Department no later than November 1, 2020.

d. A contractor who is performing public work on July 1, 2021, shall submit the registration application form and fee to the Department no later than August 1, 2021.

Section 2. Amend Section 6, Chapter 168, Volume 82 of the Laws of Delaware by making deletions as shown by strike through and insertions as shown by underline as follows:

Section 6.  This Act takes effect October 1, 2020 upon promulgation of final regulations adopted under this chapter, or on July 1, 2021, whichever occurs first.

SYNOPSIS

This bill extends the effective date of the Delaware Contractor Registration Act to July 1, 2021, or upon promulgation of final regulations. The unprecedented nature of the COVID-19 pandemic facing Delaware and the nation necessitates moving the implementation of the law until July 1, 2021, or upon promulgation of final regulations. The bill also extends the effective date of changes to the Workplace Fraud Act to mirror the effective date of the Delaware Contractor Registration Act. This will facilitate enforcement and alleviate logistical issues with the implementation of the contractor registry.
