SENATE BILL NO. 239

AN ACT TO AMEND SECTION 6607 OF TITLE 16 OF THE DELAWARE CODE RELATING TO FIRE PREVENTION.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):

Section 1.Amend §6607, Title 16 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

(d) A boundary between fire companies recognized by the State Fire Prevention Commission shall be binding notwithstanding any other provision of the Code, state law, any county or municipal ordinance or any rules or regulations to the contrary and shall not be impacted by the subsequent annexation of any area by any municipality.

SYNOPSIS

This legislation establishes that the determination of fire company boundaries by the Fire Prevention Commission shall prevail over any other provision of the Code, state law, any county or municipal ordinance or any rules or regulations to the contrary.
