AN ACT PROPOSING AN AMENDMENT TO THE DELAWARE CONSTITUTION RELATING TO A VACANCY IN THE OFFICE OF LIEUTENANT GOVERNOR. |
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE (Two-thirds of all members elected to each house thereof concurring therein):
Section 1.Amend Article III of the Delaware Constitution by making deletions as shown by strike through and insertions as shown by underline as follows:
§ 25.Vacancy in the Office of Lieutenant Governor; tenure of office of person elected to fill.
Section 6. Whenever there shall be a vacancy in the office of Lieutenant Governor, by reason of failure to elect, ineligibility, death, resignation or otherwise, a writ of election shall be issued by the Governor, or in case of necessity in such other manner as shall be provided by law; and the person thereupon chosen to fill such vacancy shall hold office for the residue of the term.
SYNOPSIS
This is the 1st Leg of a Constitutional Amendment to hold a special election when there is a vacancy in the office of the Lieutenant Governor.It is modeled after the special election for the Legislative seats.As is the case with the Legislative special elections, the details of the special election process will be placed in Title 15 of the Delaware Code when the 2nd Leg of the Constitutional Amendment is passed by the following General Assembly and the Amendment becomes part of the Delaware Constitution. |
