SENATE BILL NO. 206

AN ACT TO AMEND TITLE 10 OF THE DELAWARE CODE RELATING TO GENERAL PROVISION APPLICABLE TO VACANCIES IN OFFICE FOR COMMISSIONERS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend §1991, Title 10 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 1991 Appointment of commissioner or commissioners; term, vacancies and qualifications.

(b) Vacancies in office shall be filled for the unexpired term by the Governor with the consent of a majority of all of the members elected to the Senate. Vacancies in office shall be filled for a term of 4 years by the Governor, with the consent of a majority of all members elected to the Senate.


SYNOPSIS

This Act updates a general provision of the code to reflect current practice and conform with specific statutory language applicable to the appointment of a vacant office for a commissioner in the Superior Court or the Court of Common Pleas.
