SENATE BILL NO. 193

AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO MAMMOGRAMS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend Title 16 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

CHAPTER 32 A. INFORMATION ON SUPPLEMENTAL BREAST CANCER SCREENING.

§3201 A. Provisions of information relating to mammography reports.

(a) On completion of a mammogram, a mammography facility certified by the United States Food and Drug Administration shall provide to each patient for whom the mammogram indicated the presence of dense breast tissue the following notice:

"Your mammogram shows that you have dense breast tissue, which could hide abnormalities.  Dense breast tissue, in and of itself, is a relatively common condition. Therefore, this information is not  provided to cause undue concern, but rather to raise your awareness and to promote discussion with your physician  regarding the presence of other risk factors, in addition to dense breast tissue. Together, you can decide which screening options are right for you.  A report of your mammography results was sent to your physician. You should contact your physician if you have any questions or concerns regarding this report."

(b) Notwithstanding any other law, this section does not create a cause of action or create a standard of care, obligation, or duty that provides a basis for a cause of action.

(c) The information required by this section or evidence that a person violated this section is not admissible in a civil, judicial, or administrative proceeding.

Section 2. A mammography facility is not required to comply with the requirements of Chapter 32A of Title 16, until January 1, 2015.


SYNOPSIS

This bill requires a mammography service provider to provide specific notice to a patient if that patient presents with dense breast tissue.
