AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO REORGANIZED VOCATIONAL-TECHNICAL SCHOOL DISTRICTS. |
Section 1.Amend §1041(1), Title 14, Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
(1) "Reorganized school district" as used in this subchapter means a school district constituted and established under this chapter whether by reorganization, consolidation or division.This definition shall include the reorganized vocational-technical school districts.
Section 2.Amend §1064, Title 14, Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
§1064 Reorganized vocational-technical school districts.
(a) The members of the school board
of any reorganized vocational-technical school district shall be appointed by
the Governor from the residents of such district. The school board shall be
composed of 7 members. Annually, the Governor shall appoint 1 member for the
term of 7 years to fill the vacancy caused by the expiration of the term of the
member whose term expires at such time. Any vacancy in the office of any such
member, caused by death, resignation, removal from the district or any other
cause whatever, shall be filled by the Governor for the unexpired term. Every
member, at all times, shall be a resident of the reorganized
vocational-technical school district, or that member's office shall be
considered vacant and a successor shall be appointed for the unexpired term as
provided in this section. After the expiration of the terms of the present
members, not more than 4 members of the school board shall be of the same
political party, and no member shall fail to state that member's own political
affiliation.
(b) In the case of any reorganized
vocational-technical school district which will not have, after reorganization,
at least 7 school board members serving pursuant to §1061 of this title, the
Governor shall appoint such members as are necessary to bring the total number
of school board members to 7 and shall designate the terms of such appointed
members so that the term of 1 member shall expire each year thereafter for the
succeeding 7 years. Not more than 4 members of the school board shall be of the
same political party, and no member shall fail to state that member's own
political affiliation.
(c) The terms of the school board
members shall begin July 1 following their appointments and shall continue
until their successors qualify.
Notwithstanding anything in this Code to the contrary:
(1) The school board of any reorganized Vocational-Technical school board shall consist of the following members:
a.New Castle County – 6 members, 1 from each of the following pairs of New Castle County Councilmanic Districts:1 & 9 is District A, 2 & 3 is District B, 4 & 8 is District C, 5 & 11 is District D, 6 & 12 is District E, 7 & 10 is District F;
b.Kent County – 6 members, 1 from each Kent County Levy Court District except for the at-large district; and
c.Sussex County – 5 members, 1 from each Sussex County Councilmanic District.
(2) Vocational-Technical school board members shall be elected for 4 year terms by the voters of the District which he or she represents.
(3) Vocational-Technical school board members shall serve staggered terms, elected on even numbered years.
(4) Every Vocational-Technical school board member, at all times, shall be a resident of the District from which he or she was elected.
Section 3.Amend §1071(b)(4), Title 14, Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:
(4) "Reorganized school district" means a school district constituted and established in accordance with this chapter whether by reorganization, consolidation or division.This definition shall include the reorganized vocational-technical school districts.
Section 4.All of the Vocational-Technical School Board members shall be elected in the election of 2016.First Election in New Castle County: 4-year terms from Districts A, C, and E; 2-year terms from Districts B, D and F.First Election in Kent County: 4-year terms from Districts 1,3,5; 2-year terms from Districts 2,4,6.First Election in Sussex County: 4-year terms from Districts 1,3,5; 2-year terms from Districts 2, 4.The terms of all appointed Vocational-Technical School Board members shall expire upon the commencement of the terms of office of the initially elected Vocational-Technical School Board members.
Section 5.This Act shall become effective January 1, 2016.
SYNOPSIS
This Act changes the composition of the County Vocational-Technical School Boards from 7 members appointed by the Governor for 7-year terms, to 6 members [New Castle County and Kent] or 5 members [Sussex] elected in Districts for 4 year terms as of 2016. |
