150th GENERAL ASSEMBLY

SENATE BILL NO. 129

AN ACT TO AMEND TITLE 9 OF THE DELAWARE CODE RELATING TO LIMITATIONS ON TAXING POWER.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend § 8106, Title 9 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 8106. Specific organizations and purposes.

(a) No real property owned and used by the organizations listed below or for the purposes stated below, except that which is held by way of investment, shall be liable to taxation and assessment for public purposes by any county or other political subdivision of this State.

Serenity Place, Inc.

Any land bank formed under Chapter 47 of Title 31.

Atlantic Community Thrift Shop, Inc. (A.C.T.S.).

Blades Economic Development Corporation.

First State Head Quarters, Inc.

Historic Georgetown Association, Inc.

Justin W. Jennings Foundation, Inc.

La Esperanza, Inc.

Laurel Community Foundation, Inc.

N.R.Y.C., Co.

Peach Tree Acres Incorporated

People’s Place Properties, Inc.

Richard Allen Coaltion, Inc.

Immanuel Shelter, Inc.

The Skating Club of Wilmington, Inc.

SYNOPSIS

This Act exempts a number of nonprofit corporations from property taxation or assessment by a county or other political subdivision of the State.
