AN ACT TO AMEND TITLE 18 OF THE DELAWARE CODE RELATING TO LICENSING OF PRODUCERS.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Section 1706 of Title 18 of the Delaware Code by making deletions as shown by strikethrough and insertions as shown by underlining as follows:

§1706Application for license.

(b)Each resident application shall further contain a statement of the applicant's criminal history, which the applicant shall obtain from the Delaware State Bureau of Identification pursuant to §8513(a)(2) of Title 11.Each resident applicant and nonresident applicant that has declared Delaware to be his or her home state shall also provide a federal criminal history report from the Federal Bureau of Identification.Any person applying for a resident license (whether a resident applicant or a nonresident applicant that has declared Delaware to be his or her home state) shall submit, to the State Bureau of Identification, their name, Social Security number, age, race, sex, date of birth, height, weight, hair and eye color, address of legal residence and such other information as may be necessary to obtain a report of the person's entire criminal history record from the State Bureau of Identification and a report of the person's entire federal criminal history pursuant to the Federal Bureau of Investigation appropriation of Title II of Public Law 92-544 [42 U.S.C. §250a].The State Bureau of Identification shall be the intermediary for purposes of this section and the Department shall be the screening point for the receipt of said federal criminal history reports. All information obtained pursuant to this subsection shall be forwarded by the State Bureau of Identification to the Department.All costs associated with obtaining the criminal history reports required by this subsection shall be borne by the applicant.
