HOUSE CONCURRENT RESOLUTION NO. 47

REQUESTING THAT THE PUBLIC SERVICE COMMISSION CONSIDER GIVING SPECIAL CONSIDERATION TO MEETING THE REQUIREMENTS OF THE RENEWABLE ENERGY PORTFOLIO STANDARDS ACT (REPSA) ONLY TO PROJECTS UTILIZING ELIGIBLE ENERGY RESOURCES.



WHEREAS, solar and wind generation produce negligible carbon (CO2) or other emissions during their operation; and 

WHEREAS, solid oxide fuel cells can be fueled by renewable fuels (as defined in Title 26, section 352 of the Delaware Code) and they can be fueled by non-renewable fuels are typically powered by hydrogen; and

WHEREAS incentives and clean energy credits in Delaware are limited, and should be focused on projects utilizing renewable fuels and those producing a minimum of CO2, climate change impact, or both;

NOW, THEREFORE:

BE IT RESOLVED by the House of Representatives of the 148th General Assembly of the State of Delaware, the Senate concurring therein, that:

(1) In the event a regulated electric utility files a docket before the Public Service Commission for tariff approval to pay for new power generation that is intended to assist the state in meeting its Renewable Energy Portfolio Standards, the Commission, where lawful, feasible, and desirable, should consider only approving projects utilizing eligible energy resources (as defined in Title 26, section 352 of the Delaware Code); and

(2) For projects installed after this resolution's enactment, where lawful, feasible, and desirable, the Public Service Commission when certifying new renewable installations or Solar Renewable Energy Credit multipliers, should consider doing so only for power generated exclusively with eligible energy resources.


SYNOPSIS

This resolution provides that the Public Service Commission should consider only approving electricity generating projects being developed to assist the state in meeting its Renewable Energy Portfolio Standards that utilize eligible energy resources, and to consider certifying new renewable installations that are generated from projects developed after the enactment of this legislation that utilize only eligible energy resources.
