HOUSE BILL NO. 78

AN ACT TO AMEND TITLE 13 OF THE DELAWARE CODE RELATING TO CHILD SUPERVISION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 7, Title 13 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§711Duty to Supervise

(a)No parent, guardian, or custodian may allow a child under the age of 12 to be left without adequate supervision while the child is in their custody.

(b) For purposes of this section "adequate supervision" means the child is subject to reasonable care and supervision by a person who is at least 12 years old.

(c) Any child under the age of 12 left without adequate supervision shall be placed in the care and custody of the responding law enforcement agency or the Department of Services for Children, Youth and their Families until the parent, guardian, or custodian may be located.

(d) The Department of Services for Children, Youth and their Families shall investigate any reported violation under this section and take any action as may be deemed appropriate.


SYNOPSIS

This bill prohibits any child under the age of 12 from being left alone without adequate supervision.The use of a babysitter who is at least 12 years old is permissible under this bill.This bill codifies existing regulations implemented by the Delaware Division of Family Services.
