HOUSE BILL NO. 489

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO SPECIAL LICENSE OR REGISTRATION PLATES FOR FLYERS CHARITIES.



WHEREAS, Flyers Charities is a division of the Comcast-Spectacor Foundation; and

WHEREAS, Comcast-Spectacor Foundation is committed to improving the quality of life in the Greater Philadelphia Region, including Delaware, through contributions, donations, player appearances and random gifts of kindness on behalf of the company's entities; and

WHEREAS, the Comcast-Spectacor Foundation focuses on non-profit organizations benefiting local youth and important healthcare initiatives; and

WHEREAS, a Flyers Charities license plate program will help raise both money and awareness for their philanthropic activities in Delaware.

NOW, THEREFORE:

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1.Amend Chapter 21, Title 21, Delaware Code by adding a new section to read as follows:

"§ 2139N.Special license plate for Flyers Charities.

(a)(1) The owner of any vehicle described in paragraph (a)(2) of this section may apply to the Department for the assignment to that vehicle of a special Flyers Charities registration.

(2) This section applies to:

a. A private passenger vehicle; or

b. A truck or van with a three-fourth ton or smaller manufacturer's rated capacity; or

c. A recreational vehicle.

(b) Upon the initial application for a plate to be issued pursuant to this section, a one-time fee will be assessed by the Comcast-Spectacor Foundation, which must include an administrative fee of $35, and is required in addition to the annual registration fee required by this title.This additional fee is required for all persons applying for this Flyers Charities plate.A replacement plate may be obtained upon payment of a fee to be set by the Division of Motor Vehicles (Division) which shall cover the cost of the plate.

(c) The one-time administrative fee collected pursuant to subsection (b) of this section shall be deposited into a special fund and used by the Division for the purpose of administering this section and to fund Division projects notwithstanding the provisions of Chapters 13 and 14 of Title 2 of this Code to the contrary.

(d) The Department shall reserve sufficient license plates including the letters "FL" and numbered consecutively beginning with the numeral "1" as are necessary to implement this section.

(e) The Division may promulgate rules and regulations as required to administer this section.

(f) At least 100 applications for this special plate must be received before the Division will approve the issuance of the special plates authorized by this section.".

Section 2. Amend §2140(g), Title 21, Delaware Code by adding the following:

"(10) Flyers Charities plates, provided that at least 100 applications for the special plates have been received before the Division of Motor Vehicles will approve the issuance of the special plates.".


SYNOPSIS

This Act creates a special license plate for Flyers Charities which will help raise both money and awareness for the charity's philanthropic activities in Delaware.The threshold for license plates is lowered from 200 to 100 by this bill, in order to allow the Comcast-Spectacor Foundation to gain a stronger charitable presence in Delaware.Past beneficiaries of the charity include but are not limited to – Penn Hospice at Rittenhouse, Rodney Street Tennis & Tutoring Association, YMCA, Firefly Literacy Fund, Virtua Foundation, Foundation for Melanoma Research, Arthur Ashe Youth Tennis & Education Center, Ed Snider Youth Hockey Foundation, and Living Beyond Breast Cancer.
