HOUSE BILL NO. 454

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO STATE GOVERNMENT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1. Amend Chapter 80, Title 29 of the Delaware Code by striking in its entirety § 8013, entitled "Council on Soil and Water Conservation."

Section 2. Amend Chapter 80 of the Delaware Code by striking in its entirety §8015, entitled "Council on Environmental Control."

Section 3. Amend Chapter 111, Title 29 of the Delaware Code by striking in its entirety Chapter 111, entitled "Delmarva Advisory Council."

Section 4.This Act shall take effect on the later of (i) June 30, 2010; or (ii) the date of its enactment


SYNOPSIS

In the spring of 2009, the Joint Sunset Committee received a list of inactive Councils from the Governor's Office.The Joint Sunset Committee notified each oversight agency of Committee's intent to sunset each inactive Council on June 30, 2010.Each oversight agency responded to the Committee indicating that the Council was in fact inactive and the Committee held a public hearing in regard to sunsetting these entities.In April 2010, the Joint Sunset Committee voted to sunset the Council on Soil and Water, the Council on Environmental Control, and the Delmarva Advisory Council.This Act eliminates those committees as of June 30, 2010, or as of the date of this Act's enactment into law if such date is later than June 30, 2010.
