SYNOPSIS

Delaware's Confidentiality of Personal Health Information Statute prevents DHSS from engaging in activities, permitted under federal HIPAA, which would protect Delaware residents. This legislation carves out 4 narrow exceptions which would allow DHSS to release protected health information for law enforcement activities, pursuant to court order, for patient care and coordination, and for healthcare business operations. The federal HIPAA law applies in Delaware, and these exceptions allow entities to share information under guidelines set forth by HIPAA.HIPAA provides strict rules for the use of this information, prohibits unauthorized subsequent sharing of the information, and provides money damages if the HIPAA rules are violated.Health care providers and related businesses are trained in and familiar with HIPAA rules.Other health care entities in Delaware regularly engage in the activities listed in this legislation and this Act would permit DHSS to engage in the activities as well.
