HOUSE BILL NO. 432

AN ACT TO AMEND TITLE 4 OF THE DELAWARE CODE RELATING TO SPIRITS, WINE, AND BEER TASTING.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §101(39), Title 4 of the Delaware Code by deleting the last sentence of said subsection in its entirety.


SYNOPSIS

The law currently prohibits sampling of beer unless it is a new product line in the marketplace for less than one year.This Act would permit the tasting or sampling of beer no matter its tenure in the marketplace.

The law also currently prohibits the sampling of spirits that are more than 80 proof.There are many "high end" spirits that are more than 80 proof and the tasting of these products could possibly convince consumers that these products are worth their higher cost.The sampling of the spirit would still be limited to no more than ½ ounce.
