HOUSE BILL NO. 427

AN ACT TO AMEND TITLE 28 OF THE DELAWARE CODE RELATING TO COMBATIVE SPORTS AND COMBATIVE SPORTS ENTERTAINMENT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Title 28 of the Delaware Code by deleting in the title to Chapter 1 the word "BOXING" and substituting in lieu thereof the words "COMBATIVE SPORTS".

Section 2.Amend §101(a), Title 28 of the Delaware Code by deleting in the first sentence the language "boxing, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 3.Amend §101(a), Title 28 of the Delaware Code by deleting in the second sentence the word "boxing" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 4.Amend §101(b), Title 28 of the Delaware Code by deleting in the first sentence the language "boxing, mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 5.Amend §101(b), Title 28 of the Delaware Code by inserting in the first sentence after the words "by combative sports" and before the words "in Delaware" the words "and combative sports entertainment".

Section 6.Amend §102(2), Title 28 of the Delaware Code by deleting the words "boxing or mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 7.Amend §102(5), Title 28 of the Delaware Code by deleting the language ""U.F.C."," as it appears therein.

Section 8.Amend §102(5), Title 28 of the Delaware Code by deleting the language ""mixed martial arts"" as it appears therein.

Section 9.Amend §102(5), Title 28 of the Delaware Code by deleting the word "boxing" as it appears after the word "unsanctioned" and before the word "or" and substituting in lieu thereof the words "combative sports".

Section 10.Amend §102(7), Title 28 of the Delaware Code by deleting the words "boxing event" as they appear therein and substituting in lieu thereof the words "combative sports".

Section 11.Amend §102(8), Title 28 of the Delaware Code by deleting the language "boxing event, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 12.Amend §102(9), Title 28 of the Delaware Code by deleting the words "Boxing and" as they appear therein.

Section 13.Amend §102(16), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 14.Amend §102, Title 28 of the Delaware Code by renumbering subsections (6) through (17) as subsections (7) through (18) respectively and inserting a new subsection (6) as follows:

"(6) 'Combative sports' shall include all professional boxing and mixed martial arts and all amateur boxing and mixed martial arts.".

Section 15. Amend §103(a), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 16.Amend §103(b), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears after the words "regulation of" and before the words "and combative" and substituting in lieu thereof the words "combative sports".

Section 17.Amend §103(b)(1), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 18.Amend §103(b)(2), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 19.Amend §103(b)(7)a., Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 20.Amend §104(a), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears in the first and the fifth sentence therein and substituting in lieu thereof the words "combative sports".

Section 21.Amend §105, Title 28 of the Delaware Code by deleting in the title to §105 the language "Boxing or mixed martial arts" and substituting in lieu thereof the words "Combative sports".

Section 22.Amend §105(a), Title 28 of the Delaware Code by deleting the language "boxing or mixed martial arts" as it appears therein after the word "professional" and before the word "event" and substituting in lieu thereof the words "combative sports".

Section 23.Amend §105(a)(2), Title 28 of the Delaware Code by deleting the language "or in the jurisdiction of the designated agent" as it appears therein.

Section 24.Amend §105(a)(3), Title 28 of the Delaware Code by deleting the word "designed" as it appears therein and substituting in lieu thereof the word "designated".

Section 25.Amend §105(a)(6), Title 28 of the Delaware Code by deleting the language "boxing or mixed martial arts" as it appears in the first, second and fourth sentence and substituting in lieu thereof the words "combative sports".

Section 26.Amend §105(a)(6), Title 28 of the Delaware Code by deleting in the first sentence the language "or in the jurisdiction of the designated agent for professional boxing" and substituting in lieu thereof the language "for professional combative sports".

Section 27.Amend §105(a)(7), Title 28 of the Delaware Code by deleting the language "boxing or mixed martial arts" as it appears in the third and fourth sentence and substituting in lieu there of the words "combative sports".

Section 28.Amend §105(b), Title 28 of the Delaware Code by deleting the language "boxing or mixed martial arts" as it appears after the words "in an amateur" and before the words "event unless" and substituting in lieu thereof the words "combative sports".

Section 29.Amend §105(b)(1), Title 28 of the Delaware Code by deleting the words "boxing or mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 30.Amend §105(b)(2), Title 28 of the Delaware Code by deleting the words "boxing or mixed martial arts" as it appears therein and substituting in lieu thereof the words "combative sports".

Section 31.Amend §105(b)(3), Title 28 of the Delaware Code by deleting the language "sanctioning organization's" as it appears therein and substituting in lieu thereof the language "Division's".

Section 32.Amend §105(b)(5), Title 28 of the Delaware Code by deleting the first sentence in its entirety and substituting in lieu thereof the following sentence "No contestant shall be licensed to participate in a combative sports event unless certified as physically and mentally fit by a medical doctor licensed by the State for amateur combative sports events.

Section 33.Amend §105(b)(5), Title 28 of the Delaware Code by deleting in the second and fourth sentence the language "boxing or mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 34.Amend §105(b)(6), Title 28 of the Delaware Code by deleting in the third and fourth sentence the language "boxing or mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 35.Amend §106(a), Title 28 of the Delaware Code by adding the language "advertise," after the word "may" and before the word "hold".

Section 36.Amend §106(a), Title 28 of the Delaware Code by adding the language "advertise," after the words "permit to" and before the word "hold".

Section 37.Amend §106(a), Title 28 of the Delaware Code by adding the following language at the end of the subsection:

"All forms of advertising shall prominently display the permit number issued for the event.If the advertisement is in other than a written format the permit number shall be verbally announced within the advertisement.".

Section 38.Amend Title 28 of the Delaware Code by adding new §106A as follows:

"§106ACombative sports entertainment requirements

(a)No person shall hold, conduct, or exhibit any combative sports entertainment event unless such person:

(1) Provides for emergency equipment and personnel to be present at the permitted event. Minimum emergency equipment and personnel shall consist of an ambulance and 2 EMTs who shall be present and on site at all times during the event; and

(2) Provides for adequate security personnel to maintain order and provide safety during and after the event.

(b)If the services of any fire company, police agency, paramedic, and/or emergency medical services provider is used for any participant of a combative sport entertainment event then the promoter of such event shall be responsible for and shall pay the costs of the services provided by the fire company, police agency, paramedic, and/or emergency medical services provider.".

Section 39.Amend §107(1), Title 28 of the Delaware Code by deleting the language "boxing or mixed martial arts" as it appears twice in the first sentence and substituting in lieu thereof the words "combative sports".

Section 40.Amend §108(b), Title 28 of the Delaware Code by deleting the language "boxing, mixed martial arts" as it appears in the first and second sentence and substituting in lieu thereof the words "combative sports".

Section 41.Amend §108(c), Title 28 of the Delaware Code by deleting the language "boxing or mixed martial arts" as it appears twice therein and substituting in lieu thereof the words "combative sports".

Section 42.Amend §108, Title 28 of the Delaware Code by inserting a new subsection (e) as follows:

"(e)If the services of any fire company, police agency, paramedic, and/or emergency medical services provider is used for any participant in any unsanctioned event then the promoter of such event shall be responsible for and shall pay the costs of the services provided by the fire company, police agency, paramedic, and/or emergency medical services provider in addition to any other penalties specified herein.".

Section 43.Amend §109(a), Title 28 of the Delaware Code by deleting the word "sporting" as it appears after the word "combative" and before the word "event" and substituting in lieu thereof the words "sports or combative sports entertainment".

Section 44.Amend §109(a), Title 28 of the Delaware Code by inserting the language "and combative sports entertainment" after the language "relating to combative sports" and before the period ".".

Section 45.Amend §109(b)(1), Title 28 of the Delaware Code by deleting the language "boxing event, mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 46.Amend §109(b)(2), Title 28 of the Delaware Code by deleting the language "boxing event, mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 47.Amend §109(b)(3), Title 28 of the Delaware Code by deleting the language "boxing event, mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 48.Amend §109(b)(4), Title 28 of the Delaware Code by deleting the language "boxing event, mixed martial arts" and substituting in lieu thereof the words "combative sports".

Section 49.Amend §110, Title 28 of the Delaware Code by deleting the language "Boxing and" as it appears in the title of §110.

Section 50.Amend §110(a), Title 28 of the Delaware Code by deleting the language "Boxing and" as it appears therein.

Section 51.Amend §110(b), Title 28 of the Delaware Code by deleting the number "5" as it appears therein and substituting in lieu thereof the number "7".

Section 52.Amend §110(c), Title 28 of the Delaware Code by deleting the language "Boxing and" as it appears after the word "The" and before the word "Combative".

Section 53.Amend §110(c)(1), Title 28 of the Delaware Code by deleting the language "boxing and" as it appears after the words "state of" and before the words "sports entertainment" and substituting in lieu thereof the language "combative sports and combative".

Section 54.Amend §110(c)(1), Title 28 of the Delaware code by deleting the word "boxing" as it appears after the words "participation in" and before the words "and combative" and substituting in lieu thereofthe words "combative sports".

SYNOPSIS

This bill provides that a person holding a combative sports entertainment event must provide for adequate security and emergency equipment and personnel to be present at the event. Additionally, if the services of any fire company, police agency, paramedic and/or emergency medical services provider is used for any participant of such event then the promoter of such event shall be responsible for the costs of the services provided. The bill also provides that no person may advertise a combative sports entertainment event without first obtaining a permit to advertise such event. The bill also defines combative sports to include boxing and mixed martial arts.
