HOUSE BILL NO. 40

AN ACT TO AMEND TITLE 29 OF THE DELAWARE CODE RELATING TO GRANTS-IN-AID.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

Section 1. Amend Chapter 63, Title 29 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:

§ 6341A Grants-In-Aid Committee.

(a) There shall be a Grants-In-Aid Committee “Committee”. The purpose of the Committee shall be to review requests for grants-in-aid and develop and recommend the grants-in-aid appropriations bill to the Joint Finance Committee.

(b) The Grants-In-Aid Committee is composed of 3 members of the Senate appointed by the President Pro Tempore and 3 members of the House of Representatives appointed by the Speaker of the House. Not more than 2 Senate appointees, nor 2 House appointees, may belong to the same political party. The Chairperson and Vice Chairperson of the Committee alternate each year between a Representative appointed by the Speaker of the House and a Senator appointed by the President Pro Tem of the Senate. During odd-numbered years, a Senator serves as Chairperson and a Representative serves as Vice Chairperson; during even-numbered years, a Representative serves as Chairperson and a Senator serves as Vice Chairperson. The Controller General’s Office shall provide staffing for the Committee.

(c) The Grants-In-Aid Committee shall:

1. Review the performance, financial stability, financial controls, audits, and efficiency of each Grants-In-Aid applicant.

2. Require itemized disclosure of all state and other revenues received by the applicant from other government entities.

3. Require itemized disclosure of any grants received by the applicant.

4. Require a summary of donations from other sources to the applicant.

(d) The Grants-In-Aid Committee may require other financial documents as it determines to be relevant to the Committee’s review of each applicant.

(e) The Chairperson, the Vice Chairperson, and Members of the Grants-In-Aid Committee shall be compensated at the rate of the Joint Legislative Oversight and Sunset Committee for their service on the Committee.

Section 2. This Act shall take effect on August 1, 2023.

SYNOPSIS

This bill creates the Grants-In-Aid Committee. The Committee is a joint committee of the Senate and House of Representatives. The purpose of the Committee is to view applications for grants-in-aid and to develop and recommend to the Joint Finance Committee the grants-in-aid appropriations bill.
