HOUSE BILL NO. 397

AN ACT TO AMEND TITLE 26 OF THE DELAWARE CODE RELATING TO THE PUBLIC SERVICE COMMISSION.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend Chapter 1 of Title 26 of the Delaware Code by making insertions as shown by underlining and deletions as shown by strikethrough as follows:

§616.Franchisee worker classification.

Individuals who are parties to a franchise agreement as set out by the Federal Trade Commission shall not be deemed employees for purposes of Chapter 11 of Title 19.

§616617. Preemption.

Any provision of this chapter, or of any franchise issued pursuant thereto, or any rule, regulation or practice, adopted or imposed by the Commission, which is inconsistent with the Communications Act of 1934, as amended, or any final rule or regulation now or hereafter adopted by the Federal Communications Commission shall be null and void. This chapter is intended to preempt any county franchising or regulation of cable television or communication systems.


SYNOPSIS

This bill clarifies that individuals entering into a cable television franchise agreement with the Public Service Commission are not thereby employees for purposes of the Wage Payment and Collection Act.
